Court makes order to CID on safety of Harak Kata et. al.

  • Says outside visits only under CID Public Complaints OIC and with hands, legs cuffed

If suspected drug dealers and criminals Nadun Chinthaka alias “Harak Kata” and Salindu Malshika Gunaratne alias “Panadure Kudu Salindu” are taken out of the Criminal Investigations Department (CID) for any investigation, the Colombo Fort Magistrate’s Court yesterday (29) ordered that the suspects’ hands and legs be cuffed and that they be placed under the custody of the Officer-in-Charge (OIC) of the CID’s Public Complaints Division.

Taking into account the requests made by lawyers appearing for the suspects, Colombo Fort Magistrate Thilina Gamage last week ordered the Director of the CID to furnish a report on the measures which could be taken to ensure the suspects’ safety within one week. The relevant report was submitted to the Court yesterday.

Accordingly, the Magistrate ordered the CID to cuff the suspects’ hands and legs if they are taken out of the CID for any investigation. As the investigations against the suspects are being carried out under the Public Complaints’ Division OIC, Inspector of Police Thusitha Kahagalle, the Magistrate ordered that the suspects be taken out for investigation purposes under his (Kahagalle’s) custody.

The CID which brought back the suspects on 15 March after the duo was arrested by the Madagascan authorities, had obtained a three-months detention order under the Prevention of Terrorism  (Temporary Provisions) Act to interrogate them. Meanwhile, the suspects’ family members had filed petitions before the Court of Appeal, raising concerns about the potential threats to their life, and thereby seeking an interim order instructing the CID to ensure their safety.
